Supreme Chutzpah

From The New York Times:

[Supreme Court Justice Clarence Thomas and Dallas real estate magnate and a major contributor to conservative causes, Harlan Crow] met in the mid-1990s, a few years after Justice Thomas joined the court. Since then, Mr. Crow has done many favors for the justice and his wife, Virginia, helping finance a Savannah library project dedicated to Justice Thomas, presenting him with a Bible that belonged to Frederick Douglass and reportedly providing $500,000 for Ms. Thomas to start a Tea Party-related group. They have also spent time together at gatherings of prominent Republicans and businesspeople at Mr. Crow’s Adirondacks estate and his camp in East Texas. In several instances, news reports of Mr. Crow’s largess provoked controversy and questions, adding fuel to a rising debate about Supreme Court ethics.

Judicial Ac-tea-vism

Yesterday, a conservative district court judge appointed by President Ronald Reagan ruled that the individual mandate in the Affordable Care Act is unconstitutional, arguing further that, since he believes the mandate is “inextricably linked” to the rest of the measure, the entire law must be unconstitutional. “The act, like a defectively designed watch, needs to be redesigned and reconstructed by the watchmaker,” Judge Roger Vinson wrote. The ruling, however, contradicts 14 other court decisions, the opinion of over 100 law professors, not to mention recent polling showing that Americans want the law to be either protected or expanded. There is also a distinctly political aspect to the ruling. Vinson acknowledged borrowing heavily in his opinion from a brief written by the right-wing group Family Research Council, and he seemed to give a shout-out to the Tea Party in his ruling, which has long targeted health care reforms as “economic Marxism.”

The Cain Scrutiny

This weekend, David and Charles Koch, co-owners of the Koch Industries conglomerate of chemical, timber, oil and manufacturing interests, are hosting their twice annual meeting to coordinate strategy and raise funds for the conservative movement. In October, ThinkProgress brought these meetings to light with a memo detailing the last Koch event, held in June, where corporate interests collaborated to help Republicans dominate the election last year. The memo we published showed that the last meeting included a number of wealthy business executives, along with leaders from the U.S. Chamber of Commerce and Glenn Beck. Previous meetings have featured top Republican politicians and conservative Supreme Court justices [Antonin Scalia and Clarence Thomas].

The less bein’ said about it, the better

From MEDIA MATTERS (May 12, 2010):

Joe Scarborough and MSNBC’s Morning Joe cast devoted nearly half an hour today to discussing discredited rumors that Elena Kagan is gay — even while noting that the White House says she isn’t gay and repeatedly acknowledging that most Americans probably don’t “care.”

The discussion occupied much of the first 15 minutes of the show. Despite the fact that there is absolutely no evidence that Kagan is gay and that the White House and Kagan’s friends have unequivocally said that she isn’t gay, Scarborough portrayed the issue as a “bigger question.” Scarborough and Pat Buchanan repeatedly tied the discredited rumors to false claims that Kagan banned military recruiters from Harvard’s campus.

The purported hook for Scarborough’s discussion was the controversy over whether The Wall Street Journal‘s use of a 17-year-old photo of Kagan playing softball was intended to be a reference to the rumors.

Leading off the show, Scarborough said, “Apparently, I didn’t know this, but softball bat symbolizes a certain lifestyle.”

You know, I don’t remember this much scrutiny about  Senator Susan Collins, Harriet Miers, or Condoleezza Rice.  They’re older than Elena Kagan and unmarried.  How do we know that they’re not in…

Judicial Restraint? Next Time, Put Him in Restraints!

As I wrote at the time, I thought the condemnations of Rep. Joe Wilson’s heckling of Barack Obama during his September health care speech were histrionic and excessive.  Wilson and Obama are both political actors, it occurred in the middle of a political speech about a highly political dispute, and while the outburst was indecorous and impolite, Obama is not entitled to be treated as royalty.  That was all much ado about nothing.  By contrast, the behavior of Justice Alito at last night’s State of the Union addressvisibly shaking his head and mouthing the words “not true” when Obama warned of the dangers of the Court’s Citizens United ruling — was a serious and substantive breach of protocol that reflects very poorly on Alito and only further undermines the credibility of the Court.  It has nothing to do with etiquette and everything to do with the Court’s ability to adhere to its intended function.
